Terms of Service

1. Using Keeps

Keeps is a private journal for families and individuals to save notes, photos, videos, and other memories. You may use Keeps only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

2. Accounts and security

To use most features you must create an account. You agree to provide accurate information and to keep your credentials secure. You must be at least 13 years old to create an account. You are responsible for activity on your account and for the people you invite to your family journal.

3. Your content

You retain ownership of the notes, photos, videos, and other content you upload to Keeps ("Your Content"). You grant Keeps a limited, worldwide, non-exclusive, royalty-free license to host, store, back up, transmit, and display Your Content solely to operate the service and make it available to you and the people you invite. This license ends when you delete Your Content or your account, subject to reasonable backup retention.

You are responsible for Your Content. Do not upload content that is unlawful, infringing, abusive, harassing, hateful, sexually explicit involving minors, or that violates anyone's privacy or rights. We may remove content or suspend accounts that violate these Terms.

4. Family accounts, sharing, and invitations

You may invite others to your family journal with either full access or limited access to specific profiles. Anyone you invite can view — and, depending on their role, add, edit, or delete — the content they have access to. Admins can also generate public share links for individual memories; those links are viewable by anyone who has them until an admin revokes sharing. Please be thoughtful about who you invite and what you share.

5. Subscriptions, billing, and cancellations

Keeps offers a free tier and optional Premium subscriptions billed monthly or annually. Subscriptions purchased on the web are billed through Stripe under Stripe's terms; subscriptions purchased on iOS or Android are billed through the applicable app store under that store's terms. Subscriptions renew automatically at the end of each billing period until cancelled.

You may cancel at any time from account settings (or from the applicable app store for in-app purchases). Cancellation stops future renewals; you retain access to Premium features until the end of the current billing period. Except where required by law or expressly stated by us, subscription fees are non-refundable. Prices, plan features, and limits may change; we will give reasonable notice of material changes and they will take effect on your next renewal.

6. License to use the app (EULA)

Subject to these Terms, Keeps grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Keeps application on devices you own or control, for your personal and non-commercial use. You may not copy, modify, reverse engineer, decompile, redistribute, or create derivative works of the app, except to the extent applicable law permits. All rights not expressly granted are reserved.

If you obtained Keeps through the Apple App Store, you agree to Apple's Licensed Application End User License Agreement, which is incorporated by reference. In case of conflict with these Terms as to your use of the iOS app, Apple's EULA governs. Apple is not a party to these Terms and is not responsible for the app or any claims relating to it, but is a third-party beneficiary entitled to enforce these Terms against you.

7. Acceptable use

You agree not to (a) misuse or interfere with the service or attempt to access it in unauthorized ways; (b) upload content that violates the rights of others or applicable law; (c) use the service to harass, harm, or exploit anyone, including minors; or (d) attempt to circumvent security, rate limits, or feature restrictions.

8. Termination

You may delete your account at any time from Settings → Delete account. We may suspend or terminate your account if you violate these Terms, abuse the service, or if we need to stop providing the service. Upon termination, your right to use Keeps ends and we will delete Your Content in accordance with our Privacy Policy, subject to reasonable backup retention and legal requirements.

9. Disclaimers

Keeps is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure. You are responsible for maintaining your own copies of important memories.

10. Limitation of liability

To the fullest extent permitted by law, Keeps and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the service. Our total liability for any claim arising out of or relating to the service will not exceed the greater of the amount you paid Keeps in the 12 months preceding the claim or USD $50.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page and notify you through the app or by email where appropriate. Your continued use of Keeps after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Keeps operates, without regard to conflict-of-law principles. Nothing in these Terms limits any non-waivable rights you have under the laws of your country of residence.
